These terms and conditions apply to all orders placed with Friends from the Garden, a vegetable box delivery service operating on the West Coast of New Zealand (Hokitika, Reefton, Westport, Greymouth).
1. Orders
By placing an order you confirm that you are 18 years of age or older and that the information you provide is accurate and complete. We reserve the right to refuse or cancel any order at our discretion.
2. Product Substitutions
We grow and source produce seasonally. Where a selected item is unavailable we will substitute it with a product of equal or greater value. We will do our best to notify you of significant substitutions.
3. Delivery
Delivery is available to Coast Road, Hokitika, Reefton, Westport, and Greymouth only. Delivery days and times are communicated at the time of ordering. We will make reasonable efforts to deliver on the scheduled day; however, delivery times are not guaranteed. Risk in the goods passes to you upon delivery.
4. Payment
Payment is accepted by online banking (bank transfer) only. Payment instructions are provided in your order confirmation email. Orders are accepted on the understanding that payment will be received within the stated timeframe. We reserve the right to cancel unpaid orders.
5. Cancellations & Modifications
To cancel or modify an order please contact us as soon as possible. We cannot guarantee changes can be made once order processing has begun. For recurring arrangements, cancellations must be made before the relevant cut-off date.
6. Perishable Goods & Returns
Our products are fresh and perishable. Your rights under the Consumer Guarantees Act 1993 apply — if goods are not of acceptable quality, please contact us promptly (within 24 hours of delivery where practicable) with a description and photograph of the issue. We will offer a replacement, credit, or refund as appropriate. We are unable to accept returns of perishable items for change-of-mind reasons.
7. Privacy
We collect your name, email address, delivery address, and phone number to process and deliver your order. We do not share your personal information with third parties except as required to fulfil your order or as required by law. For full details see our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by law, our liability to you in connection with any order is limited to the price paid for that order. Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
9. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this page. Continued use of our service after changes are posted constitutes acceptance of the updated terms.
